FTP Worldwide provides a File Transfer Hosting Service. FTP Worldwide maintains certain legal and ethical responsibilities regarding the use of its host server network and equipment involved with these services.

FTP Worldwide's general policy is to act as a neutral provider of hosting services to the global Internet. FTP Worldwide has specific ethical concerns regarding the use of its servers as detailed below.  FTP Worldwide reserves the right to suspend or cancel a customer's access to any or all services provided when FTP Worldwide decides that the account has been inappropriately used.

Hosting Services

All sites provided by FTP Worldwide are for the sole purpose of storing files to be transferred by the site owner. It is the responsibility of the site owner to back up his files. All FTP Worldwide sites are provided with virtually unlimited file transfer capabilities. All sites may be upgraded at any time with additional storage space and user accounts as needed. It is at the discretion of FTP Worldwide to determine if the bandwidth used by any customers is considered excessive. If so, it may be possible for a customer to purchase additional bandwidth. FTP Worldwide provides customers the ability to monitor the activities of their site.

FTP Worldwide provides a gateway that is password protected and permits the customer to authorize access and administer their site. For privacy reasons, anonymous FTP and pseudo-anonymous FTP logins are not allowed. FTP Worldwide reserves the right to monitor all customer sites and to remove objectionable material at any time without prior notice.

Payment Policies

All pricing is guaranteed for the term of payment received. FTP Worldwide reserves the right to change prices at any time. Payments are due based on the site package billing cycle selected: monthly, quarterly, semi-annually or annually. The payment is due, in full, at the beginning of the billing cycle. Any account past due more than 7 days is subject to suspension. The customer is responsible for all money owed on the account from the time it is established to the time that the customer notifies FTP Worldwide in writing to request a termination of services.

Credit Card Orders

Accounts will be automatically billed, on a monthly, quarterly, semi-annual or annual basis, to the card number on file unless otherwise notified. All credit card payments will be billed on the day of the month their account is due.

In the event their bank declines the credit card, the customer will be notified by email or phone to the email/phone number on file. Past due accounts that are not brought current within 10 days of the notice are subject to suspension and possible account termination.

There will be a $25 Re-Activation Fee on any accounts suspended and then later re-activated. The company listed on the credit card statement will be Martec Enterprises. The customer is responsible to notify FTP Worldwide of any address changes, name changes to the credit card on file as well as updating the expiration date when necessary.

Cancellation Policy

FTP Worldwide reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Martec Enterprises if FTP Worldwide institutes its right of cancellation. If cancellation is caused by customer's violation of our policies, then no refund is due.

Due to security concerns, all account cancellation changes must be done in writing via email, US mail or Fax. The letter should include the primary contact of the account and include the Account ID and Account Name.

Within the first 30 days, customers can cancel service at any time and will be refunded any amount exceeding the pre-payment of the current term less the initial set up fee. After 30 days, FTP Worldwide will honor all cancellations based on the billing cycle of the site package being cancelled.

If any company refunds are due, a credit will be posted to the credit card on file within 15 days of receipt of cancellation. The account will be cancelled and all information deleted at the end of the current billing period, unless a date of cancellation is specified. Setup fees are not refundable.

If you are on a monthly, quarterly, semi-annual or annual billing plan and we have not been notified prior to renewal in a manner abiding by our written terms and conditions, your account will be renewed, and your credit card charged.

Password Changes

Due to security concerns, all requests for account password changes must be in writing and must be made by the customer site administrator. The request must contain the old password and the new desired password and emailed to support@FTPWorldwide.com. Telephone requests will not be responded to.

Server Use

FTP Worldwide reserves the right to refuse service and/or access to its servers to anyone. FTP Worldwide is designed for private person-to-person business file deliveries. FTP Worldwide expressly prohibits our servers from being used to distribute, store, process, or otherwise handle the following types of material:

• Adult material - Includes extreme adult material such as pornographic images, or obscene content. 

• Hacking material - Includes pirated software, phreaking, hacking, Anarchy, and any sites which provide 'links to' or 'how to' information about such material.

• Commercial Distribution – Demo, trial or software distribution; Music sharing or distribution; EBay picture hosting, Warez distribution and any other wholesale distribution considered in violation of FTP Worldwide distribution policy.

• Illegal material - This includes copyrighted works (i.e. mp3 music files, ROM's, emulators), and any material in violation of any Federal, State or Local regulation.

Overage Policy

FTP Worldwide offers various FTP hosting packages.   Each customer will have the ability to monitor his own disk space and bandwidth utilization. If the client surpasses the disk space allowed, the client can adjust their usage, by upgrading to a larger package. If the amount of bandwidth consumed is considered excessive causing the overall performance of the server to slow down, you will be notified to make the appropriate changes either to your site or to your volume of activity.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold FTP Worldwide harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against FTP Worldwide, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless FTP Worldwide against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with FTP Worldwide's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement.

Disclaimer

FTP Worldwide will not be responsible for any damages your business may suffer. FTP Worldwide makes no warranties of any kind, expressed or implied for services we provide. FTP Worldwide disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by FTP Worldwide and its employees. FTP Worldwide cannot be held responsible for prices listed on banners or on search engines, as these may be outdated. Please refer to our current pricing that is listed on our web site. FTP Worldwide reserves the right to revise its policies at any time.
